“Green Claims Directive proposal: current developments”

On 23 March 2023, the Commission submitted to the European Parliament and the Council, a proposal for a directive on substantiation and communication of explicit environmental claims (i.e., Green Claims Directive). Under this proposal, companies and traders will be required to prove voluntary claims about environmental characteristics of their products or their organisations to be verified by a third party (the “verifier” an accredited body officially established by the Member State). The European Parliament adopted its position, with further changes and several restrictions to climate-related claims, in plenary on 12 March 2024. On 17 June 2024, the Council adopted its position (‘general approach’) – which will form the basis for negotiations between the co-legislators in the new legislative cycle on the final shape of the Green Claims Directive.

This meeting aims to look and discuss the current developments of the proposed Green Claims Directive – particularly, what to expect for climate-related claims – and how this legal framework compares and fits within the international context, among developments in other non-EU jurisdictions.
