‘Green Claims’ Frameworks – A Comparative Look at Recent Developments in EU and Non-EU Jurisdictions
The corporate race towards sustainability has given rise to the proliferation of commercial practices and information using green claims. This triggered a new regulatory response by governments mainly, but not exclusively, through consumer protection and fair competition regulation.
The aim of the present analysis is to look at and take stock of several frameworks addressing the substantiation and communication of voluntary explicit environmental, namely climate related claims, and see how the EU legal framework compares and fits within the international context and among some of the developments in other non-EU jurisdictions (e.g., UK, US, Australia and Canada).
