SUMMARY:The transition plans: beyond sustainable finance?
DESCRIPTION:The idea of presenting a transition plan – i.e.\, ensuring that the business model and strategy of the undertaking are compatible with the transition to a sustainable economy and with the limiting of global warming to 1.5 °C\, in line with the Paris Agreement – will soon turn into a concrete legal obligation. It is mandated by the Corporate Sustainability Reporting Directive and contemplated in other pieces of European sustainable finance legislation: the Corporate Sustainability Due Diligence Directive and the EU Green Bonds Standard. But this kind of requirement expands beyond the sustainable finance realm. For example\, the European Parliament wants to reduce the amount of ETS free allocations for companies not having a decarbonisation plan or failing to meet their milestones. \nHowever\, it remains unclear how to turn those very forward-looking and complex commitments into real change by individual companies throughout the various business models. \nThe event aimed at identifying the objective\, scope\, and challenges in addressing the requirement of presenting transition plans in and beyond the EU corporate sustainability framework. \nAgenda    ERCST Slides

SUMMARY:(Carbon) Contracts for Difference: Priorities and Red Lines for the EU Scheme
DESCRIPTION:This workstream aims to bring together stakeholders\, including policymakers and industry on a regular basis to discuss substantive issues around the topic of (C)CfDs\, informed by original intellectual input from ERCST. \n(C)CfDs are discussed as one of the most promising alternatives to foster the deployment of low-carbon industrial technologies. DESCRIPTION:Participants in the CCUS Forum in Oslo\, hosted on 27-28 October\, discussed several issues related to a strategic vision for CCUS\, CO2 infrastructure\, and CCUS industrial partnership. \nThe Forum endorsed two documents prepared by the working groups on the CCUS Vision Strategy and CO2 Infrastructure. However\, the industrial partnership concept still requires further reflection. SUMMARY:External Event: Frontiers in Carbon Pricing
DESCRIPTION:This event is organised by the Harvard Project on Climate Agreements. It took place at COP27 at the Pavilion of the International Emissions Trading Association (IETA).  \nSome sixty jurisdictions worldwide – including both national and subnational governments – have adopted carbon-pricing policies\, largely cap-and-trade systems or carbon taxes. Very few of these policies\, however\, match the economist’s ideal – an upstream\, economy-wide emissions-trading or carbon-tax system (with specific rebate mechanisms for revenue). Most emissions trading systems include\, to varying degrees\, price collars\, rendering them\, effectively\, ETS-tax hybrids. Economists and political scientists are examining the reasons why such systems have been adopted\, and policy makers in the United States (and elsewhere) are beginning to consider how some features of pricing systems might be incorporated into non-pricing policies\, thus reducing costs\, given the apparent political difficulty of enacting carbon-pricing legislation. \nThis panel explored these and other advanced and timely topics in carbon pricing. Robert Stavins\, A.J. Meyer Professor of Energy and Economic Development at Harvard Kennedy School and Director\, Harvard Project on Climate Agreements\, moderated the discussion.

SUMMARY:ERCST at COP 27 - CBAM
DESCRIPTION:This event took place at COP27 in the Turkey Pavilion. \nIn order to address the risk of carbon leakage from the EU ETS\, in July 2021 the European Commission has put forward a proposal for a Carbon Border Adjust Mechanism (CBAM). Over the last fifteen months this proposal has gone through the EU legislative process\, which is now nearing conclusion and is expected to be completed by the end of 2022. The CBAM will not only impact trade between EU and its partners\, but is also leading to significant changes to how other countries are approaching climate change. \nThis event was an open discussion with Mr. Gerassimos Thomas who is the Director General of  Directorate of EU Taxation and Customs Union which has the primary responsibility for the CBAM legislation. \nIn this discussion\, Mr. Gerassimos was joined by international stakeholders to discuss the current direction of CBAM as well as their reactions to the introduction of this EU legislation. \n Agenda

SUMMARY:External Event - COP27: Policy measures to promote a clean energy future
DESCRIPTION:ERCST’s Executive Director\, Andrei Marcu\, spoke at this panel organised by the World Nuclear Association. \nThere has been a wave of national initiatives in countries around the world to promote clean energy investment. From policies that support existing nuclear power\, to production and investment tax credits for new clean electricity technologies\, to the promotion of clean hydrogen production\, policies in more and more countries are including nuclear energy in their results-driven efforts focused on decarbonization. \nFor example\, the U.S. government passed\, and will soon implement\, the Inflation Reduction Act\, which included game-changing tax credits that will help nuclear investment thrive. We have seen other countries invest in nuclear education and research\, which will ensure they have an adequate and skilled workforce and cutting edge technologies to meet growing demand. \nNational policies play a key role in influencing private sector investment decisions. This panel gave an insight into recent policy decisions and their ramifications. \n

SUMMARY:Border Carbon Adjustments in the EU: Launch of Report on CBAM: Aligning the design with evolving circumstances
DESCRIPTION:One of the most critically important issues of CBAM\, yet to be resolved\, is the question of how to compare the level of effort in third countries’ climate policies to that of the EU\, in order to determine crediting against the CBAM. The US\, for example\, has embarked on a suite of transformational climate-related initiatives under its Inflation Reduction Act (IRA)\, but employing subsidies rather than pricing. \nThe IRA is a particularly salient example of evolving circumstances that invite further thinking about the CBAM’s elaboration and implementation. As well as the question of whether to credit for equivalent effort\, the IRA’s heavy subsidization may have relevance for the CBAM’s design in the area of export rebates\, timeline of implementation\, and roll-back of free allocation. \nOther current events also have relevance. Many European industrial sectors were already struggling with long-term competitive challenges but are now also facing unprecedented costs because of the Russia-Ukraine war and longer-standing supply chain disruptions. SUMMARY:The principle of technological neutrality and hydrogen incentives
DESCRIPTION:This event was selected as a side event within the European Hydrogen week 2022. \nWhile the focus of the European Commission Hydrogen Strategy clearly lies on renewable hydrogen\, the strategy acknowledges that in the short and medium term\, other forms of low-carbon hydrogen are needed to rapidly reduce emissions from existing hydrogen production and support the parallel and future uptake of renewable hydrogen. In a similar approach\, the REPowerEU communication mentions that to achieve 10 million tons of EU renewable hydrogen domestic production\, other forms of fossil-free hydrogen\, notably nuclear-based are needed. \nMost of the different building blocks of the hydrogen regulatory framework were already presented in various parts of the Fit for 55 package and the hydrogen and decarbonized gas market package. However\, the translation of the policy vision for low-carbon hydrogen portrayed in the strategy and REPowerEU into the proposals is still not complete. As an example\, the European Commission has left the key elements of the low-carbon hydrogen definition for secondary legislation (to be proposed by 2024). \nThis meeting assessed three main questions: \n\nIs it possible to ramp-up the EU-hydrogen economy without the contribution of low-carbon hydrogen?\nWould a technology neutral approach to incentives based on the carbon footprint of the hydrogen produced favor the ramp-up of the EU hydrogen economy?\nHow could the demand side of the hydrogen market be supported in decarbonizing at affordable prices considering the current energy crisis?|\n\nAgenda    Recording    ERCST Slides

The roundtable is co-convened by the European Roundtable on Climate Change and Sustainable Transition (ERCST) and the World Economic Forum.  \nThe discussion will focus on the relationship between carbon pricing and trade. As carbon pricing instruments grow worldwide\, so too has interest in border carbon adjustments (BCAs)\, as a policy tool to mitigate carbon leakage. An energy crisis\, particularly in Europe\, is also setting a new context for industrial competitiveness that will affect the climate action agenda. It is not clear\, at the moment\, how or where governments will choose to address BCAs and/or carbon leakage in international or regional forums.  \nParticipants will work through a set of four possible future scenarios on carbon pricing and trade to reflect on these policy interactions and potential developments. DESCRIPTION:This workstream aims to bring together stakeholders and policymakers regularly to discuss substantive issues around hydrogen\, informed by original intellectual input from ERCST. \nFor more than 20 years\, the market has developed multiple reporting tools in response to the demand from investors for identifying which investments and economic activities can be seen as “sustainable”. \nIn 2020 the EU Taxonomy was introduced by the EU institutions as a flagship project of the sustainable finance strategy. It is meant to be an obligatory reporting tool to drive the flow of investment and give guidance to investors on economic activities that significantly contribute to the environmental objectives. \nAt the same time\, there is an ongoing expansion of other sustainability reporting requirements through other pieces of legislation: Corporate Sustainability Reporting Directive (CSRD)\, EFRAG standards\, Corporate Sustainability Due Diligence (CSDD) and amended Sustainable Finance Disclosure Regulation (SFRD). \nBusinesses increasingly understand the need to communicate with investors and the wider public about the climate and environmental risks and how undertakings want to transform toward a sustainable economy. However\, navigating the matrix of reporting becomes a challenge and the resources needed to comply are growing. SUMMARY:Roundtable: Review of the EU ETS: Financial actors\, ETS2 & compensation
DESCRIPTION:The EU ETS is considered one of the cornerstones of the EU’s climate policy. While it has been faced by many issues\, the ETS has increasingly proven to be ‘fit for purpose’ in recent years. Today\, the EU ETS stands at the dawn of a new revision process\, which will have to ensure that it helps delivering on the European Green Deal in an economically efficient way. The EU ETS Revision was adopted on 14 July 2022 as part of the Fit for 55 Package\, while the European Parliament and Council position were adopted on 22 and 28 June respectively. Trilogues started in September with the objective to achieve a final text to be implemented in 2023. Despite a number of meetings taking place\, some issues are still pending. \nERCST presented its views\, which was followed by two sessions\, each kicked-off with a 5 mins per ice-breaker initial intervention\, followed by an open roundtable discussion with participants. SUMMARY:Expert Consultation: CBAM: Different Approaches and Evolving Circumstances
DESCRIPTION:One of the most critically important issues concerning CBAM\, yet to be resolved\, is the question of how to compare the level of effort in third countries’ climate policies to that of the EU\, in order to determine crediting against the CBAM. The US\, for example\, has embarked on a suite of transformational climate-related initiatives under its Inflation Reduction Act (IRA)\, but employing subsidies rather than pricing. \nThe IRA is a particularly salient example of evolving circumstances that invite further thinking about the CBAM’s elaboration and implementation. As well as the question of whether to credit for equivalent effort\, the IRA’s heavy subsidization may have relevance for the CBAM’s design in the area of export rebates\, timeline of implementation\, and roll-back of free allocation. \nOther current events also have relevance. Many European industrial sectors were already struggling with long-term competitive challenges but are now also facing unprecedented costs because of the Russia-Ukraine war and longer-standing supply chain disruptions. Are these evolving challenges grounds for rethinking aspects of CBAM\, or for an increasing focus on parallel supporting industrial policies? \nConsidering these policy questions\, this roundtable discussion brought together global experts in the areas of economics\, law\, and policy to assess existing proposals of how to treat non-pricing policies in the EU CBAM. \nAgenda

SUMMARY:Green bonds – State of play. What is in it for transition?
DESCRIPTION:The Green Bond Standard is the flagship financial instrument incorporating the EU Taxonomy. After the Council and the European Parliament adopted their positions\, its status is entering a new phase\, the inter-institutional negotiations. It is a good moment to take stock of the different policy aspects related to green bonds: relation with the Taxonomy\, the skyrocketing demand for “sustainable” bonds and their role in financing the transition of businesses.    \nThe linkage of the EU green bonds standards with the Taxonomy caused political turbulences reflecting its controversial nature and difficult discussion over the inclusion of gas and nuclear energy into the Taxonomy. This was the reason behind the opposition of some Member States and MEPs to the new green bonds standard. Another source of controversy is the degree of alignment with the Taxonomy and the overall level of requirements. The Council allowed a 20% pocket for non-Taxonomy-related investments. The European Parliament wants much stricter rules applicable to the EU green bond standard\, including restrictions for doing business in tax havens. These negotiations reflect the need to find a balance between the desire to create the golden standard of the highest purity and the instrument of business reality. \nThis event aimed at taking stock of the EU Green Bonds initiative and identifying the challenges and opportunities related to this instrument in the context of financing the transition. \nAgenda    ERCST Slides    ERCST Publication

SUMMARY:Border Carbon Adjustment in the EU: Launch of Report on International Cooperation on BCAs/CBAM
DESCRIPTION:One of the crunch issues in the debate on the EU CBAM is the question of international cooperation on and around the CBAM. A prominent feature here are proposals of forming a carbon club or carbon alliance of countries implementing carbon pricing. In this scenario\, a BCA could act as an incentive to other countries to join. DESCRIPTION:This meeting is part of a series of events organized by ERCST on the European Green Deal. This workstream aims to bring together policymakers and stakeholders on a regular basis to take stock of current developments in the EGD framework. \nSince the the publication of the Fit for 55 proposals in July 2021\,  the legislative process is entering a crucial phase. The co-legislators advanced their positions on many key dossiers and are getting ready to enter the inter-institutional negotiations. \nHowever\, geopolitical developments led to modifications of the initial proposals which spilled over to the key EGD files as portrayed in the REPowerEU plan. DESCRIPTION:On the global stage\, countries have been reacting to the developments surrounding the EU CBAM\, and we can expect to see some follow suit. Ideally\, there would be international coordination of these emerging policies; they have high-stakes implications for international trade\, international equity\, and climate diplomacy. Some have suggested that BCAs could be an essential element of “climate clubs” or “climate alliances”\, acting both as a common tariff-like wall\, and as incentive to join. Others have called for international agreement on principles and best practice. DESCRIPTION:Since 2019\, ERCST has built up solid experience on BCAs and carbon leakage issues in the EU context. The ERCST Team has accompanied the CBAM file from its earliest stages in the legislative process\, providing analytical input to the discussion on BCAs and fostering an informed debate with domestic and international stakeholders. \nOne of the crunch issues identified by ERCST is the inclusion of indirect (scope 2) emissions in the scope of the CBAM. The Commission proposal only includes direct emissions under the CBAM\, but the Parliament is backing the inclusion of indirect emissions from the start. SUMMARY:Hydrogen and the RED Delegated Acts
DESCRIPTION:On May 20th the European Commission published two delegated acts which are essential to complete the definition of RFNBOs (Renewable Fuels of Non-Biological Origin) and hence to determine the role renewable hydrogen will play in EU decarbonization. In concrete: \n\nDelegated act on the methodology setting out the rules for the production of RFNBOs.\nDelegated act on the methodology to assess the GHG emissions of RFNBOs and recycled carbon fuels.\n\nThe deadline to provide feedback to the proposals was opened until June 17th . \nWe therefore gathered a small group of experts to discuss the proposals from different angles and perspectives. SUMMARY:Nuclear energy and gas in the EU Taxonomy
DESCRIPTION:The EU Taxonomy was introduced in 2020 as a reporting tool. The declared goal of Taxonomy is to direct the flow of private capital to finance transition towards climate neutrality. It is a flagship project of the sustainable finance strategy adopted by the European Commission as a part of the European Green Deal. \nThe Taxonomy\, being a product of the regulation – not of market participants – became a label provoking political tensions. Using this label to describe economic activities became a matter of principle\, rather than a market instrument. The illustration of this phenomenon is the political debate about qualifying gas and nuclear energy as “sustainable” activities under the Taxonomy. \nBy July 2022\, the European Parliament formally reacted to the Complementary Delegated Act (CDA) which\, under some conditions\, qualifies gas and the nuclear energy as “green” activities. \nThe panelists explored the subject-matter along those guiding questions: \n\nHow the geopolitical situation affects the role of gas and nuclear energy in the climate transition?\nHow the CDA will affect the access to finance for gas and nuclear energy projects?\nIs there an impact on renewables?\n\nAgenda    ERCST Slides
