SUMMARY:Stakeholders Consultation: Green Claims Directive (GCD) trilogues - How does the GCD connect to Voluntary Carbon Markets (VCMs)?
DESCRIPTION:This was an in person event. \nOn March 23\, 2023\, the Commission submitted to the European Parliament and the Council\, a proposal for a directive on substantiation and communication of explicit environmental claims (i.e.\, “Green Claims Directive” or “GCD”). The GCD establishes minimum requirements for the substantiation and communication of explicit voluntary environmental claims in business-to-consumer commercial practices. Within these\, climate-related claims based on carbon credits – normally issued in VCMs – are explicitly included. \nThe European Parliament adopted its position\, with further changes and several restrictions to climate-related claims\, on March 12\, 2024\, in plenary. On June 17\, 2024\, the Council adopted its position (‘general approach’) – which will form the basis for negotiations between the co-legislators in the new legislative cycle. Trilogues\, which were supposed to begin in Autum 2024\, are expected to begin in 2025 Q1 – during the Polish Presidency. \nThis stakeholders meeting aimed to look at the GCD proposal and allow a brainstorming session on: (i) how it connects with VCMs; (ii) how the discussion is important\, in the end\, for voluntary corporate action; (iii) what are the potential implications for VCMs; and (iv) what to expect from the trilogues on this matter. \n  \nDraft Agenda \nERCST Slides \nCarbon Gap Slides

This will be the tenth annual report on the State of the EU ETS and builds on the reports produced by this group of authors\, and other partners\, in the last years. SUMMARY:International townhall: CBAM implementation - One year later
DESCRIPTION:Register \nMarking the one-year anniversary of the CBAM’s transitional period\, this event will take stock of the challenges encountered during the first year of the CBAM. The discussion will focus on obstacles faced by importers\, exporters\, and other stakeholders involved in the CBAM.  How large are the difficulties in obtaining accurate data and engaging with suppliers? Has the CBAM already resulted in any shifts in behavior—such as sourcing materials locally or changing trade patterns to adapt to the challenges they face because of the CBAM? \nThese insights will lead to a conversation about how policymakers\, governments and authorities  should best prepare for the definitive period and address the unresolved challenges before the CBAM is fully implemented. While challenges will likely continue to emerge during the definitive period\, a key question remains: how do we measure the success of the CBAM so far? \nThis session\, convened by ERCST on the basis of its extensive work on the EU CBAM\, brings together policymakers and stakeholders from government\, industry and other services to discuss the challenges in CBAM implementation and how to address them moving forward into the definitive period. \nAgenda

DESCRIPTION:This was a hybrid event.  \nConsidering the momentum of the recently published EU Corporate Sustainability Due Diligence Directive (CS3D) – and its entry into force on July 25\, 2024 –\, ERCST proposes evaluating the final text of the CS3D\, building on its previous work – i.e.\, “The EU Corporate Sustainability Due Diligence Directive and its Extraterritorial Effect: Promise and Pitfalls”. \nThis analysis considers not only earlier elements from the legislative process\, namely the two previous negative opinions from the European Commission’s Regulatory Scrutiny Board and the Commission Staff Working Document\, as well as the Commission’s initial proposal. Not only will the revenue collected under the CBAM increase as the mechanism is gradually phased in over the course of nearly a decade\, but the simultaneous phasing out of free allocation will also increase the revenue generated from allowance auctioning under the EU ETS.\nThe goal of this side event is to elaborate on possible options for EU CBAM revenue use. Online participation is only allowed for attendees located outside Belgium”.  \nRegister in-person Register online \nThe Corporate Sustainability Reporting Directive (CSRD) and its delegated regulation – the European Sustainability Reporting Standards (ESRS) – require companies to disclose their transition plans for climate change mitigation\, if they have one\, and explain how these are aligned with the 1.5°C goal of the Paris Agreement. The Corporate Sustainability Due Diligence Directive (CS3D) mandates companies to adopt and implement a transition plan for climate change mitigation\, aiming to ensure\, through best efforts\, that the company’s business model and strategy are compatible with the transition to a sustainable economy and the goal of limiting global warming to 1.5°C. \nAccording to the application requirements (ESRS E1)\, current approaches suggest that companies should benchmark their efforts against the 1.5°C target. This benchmark should be based on a sectoral decarbonisation pathway\, if available for the company’s sector\, or on an economy-wide scenario\, acknowledging its limitations. However\, without clear methodologies or sector-specific pathways established by public policies\, companies\, especially those operating across multiple sectors\, face significant challenges. \nIn this context\, and among the numerous guidelines issued by private initiatives\, EFRAG is developing Implementation Guidance on Transition Plans under the CSRD\, which is expected to address some of these ambiguities. SUMMARY:Finding common ground: A debate on the role of Carbon Management technologies in decarbonisation pathways

Online participation is only allowed for attendees located outside Belgium”. \nPublic sentiment and acceptance of Industrial Carbon Management (ICM) technologies – namely Carbon Capture\, Utilization\, and Storage (CCUS) and Carbon Dioxide Removals (CDRs) – are crucial for the overall EU approach to climate action and for having them deployed on time to achieve climate neutrality by 2050. Various factors\, including the negative perceptions held by environmental advocacy groups\, significantly influence public opinion. These groups often view these technologies as unsafe\, untested\, and a hindrance to the energy transition\, potentially jeopardizing the global net zero goals set by the Paris Agreement. \nRecently\, however\, there has been a shift in public opinion. The ongoing energy crisis\, rising energy costs\, and the visible challenges of achieving the Paris Agreement’s goals have led to a reluctant but growing acceptance of ICM technologies. However\, communication between different stakeholders seems not to exist\, as they often have different views on how decarbonization and the Paris Agreement’s goals should be achieved\, and which technologies are more ‘legit’ than others. \nIn this roundtable\, various stakeholders with (opposing) views are gathered together\, intending to find common ground to move forward with developing and deploying ICM technologies and their role in decarbonisation models and achieving climate neutrality. \nSlides \nAgenda

DESCRIPTION:This is an online event. \nThe CBAM’s transitional period is now underway\, however several issues remain unresolved ahead of the definitive period and numerous delegated and implementing legislations\, along with reviews are due before the end of the transitional period. The ERCST’s third report of CBAM V will look at the topic of including products further down the value chain in the EU CBAM. \nAt this event the ERCST launched and presented a report\, which was followed by a discussion on inclusion of additional products in the value chain in the CBAM related to the review under the CBAM due at the end of 2024. The discussion covered the impact on downstream cost increases and the risk of value chain substitution for semi-manufactured and manufactured goods. As a reminder\, in many cases EU legislation is based on commitments that the EU delegation makes at COP meetings. \nCOP29 in Baku is expected to be a decisive conference for comprehensive climate action\, with topics like climate finance – including the New Collective Quantified Goals (NCQGs)\, and the upcoming Nationally Determined Contributions (NDCs) due by February 2025 – as well as the alignment of biodiversity and climate. \nThe Presidency’s vision for COP29 is to “enhance ambition\, enable action” and adopting the NCQG is listed at the top of the list under enabling action. The COP29 Presidency launched the “Climate Finance Action Fund” (CFAF)\, to receive annual contributions from fossil fuel-producing countries and companies. Initial fundraising aims for $1 billion\, with members committing to annual contributions as fixed sums or based on production volume. \nIt has become clear that private players need to enter the scene to mobilise more and more climate finance. Online participation is only allowed for attendees located outside Brussels” \nOn 23 March 2023\, the Commission submitted to the European Parliament and the Council\, a proposal for a directive on substantiation and communication of explicit environmental claims (i.e.\, Green Claims Directive). Under this proposal\, companies and traders will be required to prove voluntary claims about environmental characteristics of their products or their organisations to be verified by a third party (the “verifier” an accredited body officially established by the Member State). The European Parliament adopted its position\, with further changes and several restrictions to climate-related claims\, in plenary on 12 March 2024. SUMMARY:Focus Group - Building a cross-border CO2 infrastructure beyond the EU: risks and opportunities
DESCRIPTION:This was an online event. \nThis event was by invitation only.\n \nSince the publication of the Sustainable Carbon Cycle Communication in 2021\, CCUS and CDRs have gained increasing attention from stakeholders and policymakers and led to the adoption of various policy proposals\, such as the Carbon Removal Certification Framework\, in 2024. \nAs a next step to further incentivize the development and deployment of these technologies in the EU\, the Commission published the Industrial Carbon Management strategy in the same year. It identified three main pathways to be developed – namely\, CCS\, CCU\, and CDRs – and highlighted how building an EU’s CO2 infrastructure is meant to become one of the priorities to focus on as it is considered a key enable of the pathways. \nHowever\, the EU may need to rely on other countries’ storage capacity to achieve its net zero emissions target by 2050 for various reasons\, including the uncertainty over the volume of storage capacity in the EU and because of differences between Northern and Southern Europe. For some Member States\, opting for storing their CO2 in third countries may be the only choice. \nIn this roundtable\, participants were invited to discuss the following questions: \n           – How important is it to build a CO2 infrastructure beyond EU borders? \n           – What are the opportunities?
